Arbitration is the process by which parties engage a third party to hear and decide differences between them. The process can be mandatory, as
is the case for labour Arbitrations, or optional, as is usually the case for employment and civil litigation matters.

Although most Arbitration proceedings are confidential, certain decisions are publicly reported. A list of James’s reported decisions is available here.

James believes that the flexibility afforded to parties is one of the principal advantages of Arbitration. To that end, James can assist parties in
determining a fair process which is responsive to the size and complexity of the matter being arbitrated.
